Thank you for visiting the backporch® website (the “Website”) and/or using our mobile application (collectively the “Application”), both of which are operated and made available to you by 323 Developers, LLC (“backporch” or “us” or “we” or “our” or any other similar pronouns). We respect your privacy and have posted this Privacy Policy so that you are aware of the information that we collect about you and how we use that information. By using the Website or the Application, you signify your agreement to the terms of this Privacy Policy, which is a part of our Terms and Conditions to which you also agree when using our Website or Application. Note that this Privacy Policy does not apply to any information that you may provide us by way of any other website, or by telephone, e-mail or any other method of communication.       The only personal information we collect from you through the Website or the Application is the information you supply voluntarily. For instance, while visiting the Website or using the Application, you may be invited to provide certain personal information to us to register for and/or set up an account to use all or a portion of the Application, such as your name, address, email address, phone number, account login credentials (such as a User ID and password), a credit or debit card number or other financial information, and certain other personal information to assist us in registering you to use our Application and setting up your account (collectively, “Personally Identifiable Information”). You are under no obligation to register for or set up an account with us or to provide us any Personally Identifiable Information through the Website or the Application, although you may be unable to use all or a portion of the Application if you choose not to share this type of information with us. Simply stated, if you do not want us to have personal information about you, please do not provide it to us. If you do provide us Personally Identifiable Information, please be aware that we may combine that information with information about you that we receive from third parties, including business partners and vendors, or the information described below that we automatically collect when you visit the Website or use the Application.

    4. Cookies and Other Tracking

      We and our service providers may use cookies and other tracking mechanisms to track information about your use of the Website or the Application and may combine this information with personal information we or our service providers collect from you. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your browser to enable our systems to recognize your browser. Cookies allow a web server to transfer data to a computer for recordkeeping and other purposes. We and our third-party service providers may use “cookies” on the Website or through the Application to facilitate your ongoing access to and use of the Website and/or Application, as well as to conduct analytics on and collect usage data related to the Website and/or Application. For example, we may use cookies to remember your User ID and password, if you choose to store them. We may also use cookies to determine when your current session on the Website or Application should be logged out after a period of no activity, as well as for efficient management of the servers providing our Website and Application. There are two types of cookies we use on the Website and in the Application: session-based cookies which expire when you close out of your browser and persistent cookies which are saved on your hard drive. We only store those photos actually uploaded by you through the Application. We may also collect location information if you provide it to us or based on, for example, your mobile device’s GPS coordinates, unless you configure your operating system settings to prevent our collection of location information.

Please note that we may, subject to any applicable law, store and use the information described in this Privacy Policy in the United States or in any other country in which backporch or its service providers conduct operations.

      We do not sell or otherwise share your personal information with third parties, except: (i) to provide the Website or Application to you, including the provision of your credit or debit card number or other financial information you provide to a third party payment processor for payment of applicable subscription fees; (ii) to protect the security of the Website or the Application; (iii) to enforce our Terms and Conditions; (iv) to protect our rights in litigation or arbitration; (v) to comply with applicable laws or respond to court orders, subpoenas, or other lawful requests; (vi) to protect your safety or that of another person; (vii) to investigate, prevent or take action regarding illegal activities or suspected fraud; or (viii) as otherwise permitted or required by law. Please note that in the event that backporch is acquired by or merged into a third party, or in the event of a reorganization or consolidation of backporch, or if all or a portion of backporch’s assets are liquidated or transferred to a third party, or as part of a bankruptcy proceeding or similar transaction or event, your personal information may be among the assets transferred to the third party involved in such transaction or event.

  3. Account Settings and Choices

    If you have an active account to use the Application, you may sign in to your account and update your personal information contained in that account. You may also turn off push notifications on your mobile device if you do not want to receive that type of communication from us. If you are an Admin, you may also be able to control which other Users view the information you post to the Application by limiting access to only the Users you select.

  4. Security

    Backporch has taken certain steps to protect the security and integrity of the information described in this Privacy Policy. However, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that information will be safe from intrusion by others during transmission through the Internet or while stored on our system or otherwise in our care. The Application is for the sole use of backporch’s customers in managing their accounts and using the Application to which they have subscribed and paid all applicable fees. You are responsible for maintaining the confidentiality of your User ID and password to access your account with the Application, and you shall be responsible for any access to or use of the Website or Application by you or any person or entity using your User ID and password, whether or not such access or use has been authorized by or on behalf of you. If you choose to provide access to your account to any third party, backporch will not be held responsible for any release of your personal information that occurs as a result of such access.

    The Website and the Application may contain links to other websites. Backporch and the persons and entities that operate and/or maintain the Website and the Application are not responsible for (i) any cookies that may be placed on your computer by such other websites, (ii) the privacy policies or content of such other websites, or (iii) any personal information you may provide to or through these other websites. You should always review the privacy policies of the websites that you visit, including those that we provide links to on the Website or the Application.

  6. Using the Application or Visiting the Website from Outside the United States of America

    If you are accessing or using the Application or Website from outside of the United States of America or otherwise contacting or visiting us from outside of the United States of America, please be aware that your personal information may be transferred to, stored or processed in the United States of America, where our servers are located and our database is operated. The data protection and other laws of the United States of America and other countries might not be as comprehensive as those in the country from which you are accessing or using the Application or Website or from which you are contacting us. By providing your information, you understand that it may be transferred to our facilities and to those third parties with whom we share it as described in this Privacy Policy. By accessing or using the Application or Website from outside of the United States of America or otherwise contacting or visiting us from outside of the United States of America, you consent to: (i) the transfer of all such information to the United States of America, which may not offer an equivalent level of protection to that required in the country from which you are accessing or using the Application or Website or otherwise contacting or visiting us, including countries in the European Union, and (ii) the processing of that information by us on our servers located in the United States of America as described in this Privacy Policy.

    From time to time, we may revise or change this Privacy Policy in order to reflect changes to our Website or Application, or to accommodate new technology or legal requirements and guidelines.
